This agreement is Between _____________________ (Renter) and Aurium LLC a Nevada Corporation, operator of Maui ELdorado J116 and Hale Ono Loa 101.
ACCOMMODATIONS: We, the operator, agree to provide accomodations for a pre arranged number of guests with use of facilities common to the property. Our units are privately owned and reflects the owners' individual tastes and requirements. Please do not remove furnishings or kitchen items to another home. Furnishings may change from time to time and pictures on the web site may differ from what may be in the condo at time of rental.
EARLY DEPARTURE: We tenants understand that changes and reduction in length of stay changes cannot be easily accommodated and usually not at all. Early departure refunds are not allowed.
CHECK-OUT: Check-out time by 11:00 a.m. Arrangements for late check-outs must be made before the departure date and are subject to additional charges. Other renters may be checking in by 3PM and we need to have adequate time for clean up. If the next renter is inconvenienced by your late check out you are responsible for their accomodation until they are properly situated.
DAMAGES: We tenants agree to properly use and operate all furnishings, including electrical and gas appliances, plumbing fixtures, electronic home entertainment property, BBQs and all other items of whatsoever kind or nature provided to me during my stay for my convenience. I also agree to leave the home so that no extraordinary housekeeping will be required after my departure. I agree to both notify and reimburse The Owner for all necessary and reasonable repairs, replacement for damage or destruction of property caused by me and my guests, or for extra cleaning required. The Owner will notify you of the costs of damages or extra housekeeping within ten days after your departure. My signature below authorizes The Operator to charge my credit card on file for these costs.
LOST KEYS: You will receive access to one room key. There is a $100 fee for any lost keys. At some time keys will have been replaced by a card key issued by the front desk; then your cost of replacement is whatever the issuing front desk policy is at the time.
MAINTENANCE & REFUNDS: The Owners make every effort to assure that appliances in your home are in operating condition, and ask you to report any problems to us at 888 546 8664 as soon as they are discovered. If we are not accessible then contact Reamarkable Cleaning at 808-665-1787 for cleaning and linen issues. Our maintenance department will make every effort to correct the problem; however, at times we must wait for available service time, parts or outside service. Refunds cannot be made for inconvenience due to partial ro complete mechanical failure of appliances. In the event the unit requires major renovation and occupancy is not possible the owner reserves the right to substitute another unit at no additional cost to the renter or cancel the reservation and refund the deposit if notification is greater than 90 days before the stay.
MAXIMUM NUMBER OF PEOPLE: Each home has a maximum occupancy limit of four people, and rates are quoted based on the number of guests expected. All guests ages four and over are counted as chargeable guests. I understand that my rate was based on the number of guests I represented during the reservations process, and this number was reviewed during the registration process. Any party falsely representing the number of people in the home or exceeding the number paid for may be subject to immediate eviction without refund. Over occupancy is considered a serious violation of this rental agreement.
PETS: No PETS ARE ALLOWED AT ANY TIME.
SMOKING: These are no smoking units. If smoking is found to have occured the tenant agrees to an additional deep cleaning charge of $300.
QUIET TIME: 9:00 pm to 8:00 am. Please respect these hours for everyone's enjoyment.
RELEASE OF LIABILITY: I agree to indemnify and save and hold harmless The Owners and operator from any loss, liability, damage or cost I and my guests may incur due to occupancy of the premises or from participation in any activities on the Resort site. Any disputes arising under this Agreement shall be mediated subject to the rules of the American Arbitration Association at the branch office closest to Lahaina, Hawaii.
WEATHER CONDITIONS: There will be no refunds due to inclement weather or power outages.
REFUND OF DEPOSIT OR RENT: there are no refunds of deposits if the unit cannot be rebooked at same or higher rates. In the event the owner decides to sell the property they will make a good faith effort to transition the rental agreement to the new owner but cannot guarantee this will occur; the owner will in any case give 90 days notification of cancellation due to intended sale and if less than 90 days the renter shall be entitled to refund of all deposits plus an inconvenience fee equal to 2 days of rent for this unit.
